Important Information Regarding Harmonised OHS Legislation

The new Work Health and Safety Act (WHS) and WHS Regulations 2011 will replace all existing OHS legislation from January 2012 in all states except Victoria, South Australia and Western Australia.  We are currently collaborating with clients to align their OHS systems with this significant change.  For further information refer to the below attachments.

These new laws have serious implications for Senior Officers and Managers within your business.  Unfortunately, ignorance of your duties and responsibilities under these new laws will not constitute as a defence if you or your company is found negligent or non compliant.

Under the new WHS Act, Officers must ensure that the person conducting the business or undertaking (PCBU) for which they are Officers, comply with their obligations under the Act.  Due Diligence means that those who are classified as Officers, must demonstrate a thorough understanding of their organisation’s risks.
